About these terms
These Terms of Service govern your use of the RE1 platform and related services operated by TONYLAWSON PROPERTY & PRESTIGE (ABN 42 674 393 027), trading as tonylawson exp & HOSO. By accessing or using the platform, you agree to these terms. If you do not agree, please do not use the platform.
Definitions
- Platform means the RE1 website, dashboard, CRM, workflow tools and any related services.
- User means any person who accesses or uses the platform, including agents, staff, clients and visitors.
- Agency means the real estate business or sole operator whose account uses the platform.
- Content means any information, images, listings, documents or other material uploaded to the platform.
Accounts and access
To use certain features, you must create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. We may suspend or terminate access if we reasonably believe there has been a breach of these terms or unauthorised use.
Subscriptions and payments
Some platform features require a paid subscription. Fees are billed in advance as set out in your plan. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months unless required by law.
Free trials are offered at our discretion and convert to a paid plan unless cancelled before the trial ends.
Acceptable use
You agree not to use the platform to:
- Send spam, unsolicited messages or any communication that breaches the Australian Spam Act 2003.
- Upload content that is unlawful, defamatory, misleading, infringing or harmful.
- Attempt to gain unauthorised access to the platform or another user's account.
- Interfere with the proper working of the platform or place an unreasonable load on our infrastructure.
- Scrape, harvest or collect data without our written permission.
Your content
You retain ownership of any content you upload. By uploading content, you grant us a licence to use, store, display and transmit it as reasonably necessary to operate the platform and provide our services. You represent that you have the right to upload the content and that it does not violate any third-party rights or applicable laws.
Custom domains and websites
Where the platform allows you to connect a custom domain or publish a website, you are responsible for configuring your DNS records correctly and ensuring that your domain registration remains active. We are not responsible for downtime caused by domain, DNS or third-party service issues.
Intellectual property
The platform, its design, branding, code and underlying technology are owned by us or our licensors. These terms do not grant you any right to copy, modify, distribute or reverse-engineer any part of the platform except as permitted by law.
Disclaimer and liability
The platform is provided on an "as is" and "as available" basis. To the extent permitted by law, we exclude all warranties and limit our liability for any loss or damage arising from your use of the platform. We do not guarantee that the platform will be uninterrupted, error-free or secure at all times.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under Australian consumer law.
Not financial, legal or tax advice
Any property estimates, market commentary or reports provided through the platform are estimates based on available data and are not formal valuations, financial advice, legal advice or tax advice. You should seek independent professional advice before making decisions.
Termination
We may suspend or terminate your access to the platform at any time if you breach these terms, misuse the service or if required by law. You may also stop using the platform at any time. Upon termination, your access to certain features may cease; we will retain data as required by law or our data-retention policies.
Governing law
These terms are governed by the laws of South Australia and the Commonwealth of Australia. Any disputes will be resolved in the courts of South Australia.
Changes to these terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the platform after changes are posted constitutes acceptance of the revised terms.
